CRITICAL NOTICE — 60-DAY REPORT RETENTION POLICY: All campaign reports, delivery logs, analytics summaries, and execution data generated or hosted on Web Genie Innovation Private Limited are available for access and download for up to 60 days only from the date of creation/generation. After 60 days, reports are permanently purged from our servers and cannot be recovered under any circumstances.

1. Acceptance & Scope

By registering, accessing, or using the telecom, messaging, and communication services provided by Web Genie Innovation Private Limited ("Company", "We", "Us"), you ("User", "Client") agree to be bound by these Terms and Conditions. These terms govern all messaging channels including Bulk SMS, WhatsApp Business API, RCS (Rich Communication Services), Bulk Email, and Voice services.

2. Regulatory Compliance Framework

Users must strictly comply with all national and international telecommunication laws, regulatory mandates, and platform-specific guidelines applicable to sending communication campaigns.

2.1 SMS Compliance (TRAI & DLT Rules - India)

Mandatory DLT Registration: In accordance with TRAI (Telecom Regulatory Authority of India) regulations under TCCCPR 2018, all entity registrations, Telemarketer IDs, Header/Sender IDs, and Message Templates must be approved on the Distributed Ledger Technology (DLT) portal prior to sending any SMS.
Consent & Scrubbing: Promotional messages must only be sent to recipients who have explicitly opted in or are scrubbed against the National Do Not Call (NDNC) / Preference Register.
Template Uniformity: The actual SMS content sent must strictly match the approved DLT template. Any deviation will lead to immediate message blocking and potential account suspension.
Time Restrictions: Promotional SMS campaigns must adhere strictly to TRAI mandated hours (9:00 AM to 9:00 PM IST).

2.2 WhatsApp Messaging Compliance (Meta Platform Rules)

Meta Commerce & Business Policies: All WhatsApp campaigns must comply with Meta's WhatsApp Business Terms, WhatsApp Commerce Policy, and Business Messaging Policy.
Template Approval: Outbound business-initiated communications must use pre-approved WhatsApp Message Templates. Sending unapproved or deceptive content is strictly prohibited.
Opt-In Requirements: Users must obtain verifiable opt-in consent from recipients before initiating WhatsApp communications.
Quality Score & Account Standing: High user block rates or policy violations may result in template rejection, messaging tier reduction, or permanent Meta API ban. Web Genie Innovation Private Limited is not responsible for penalties imposed by Meta.

2.3 RCS Compliance (Google & Carrier Guidelines)

RCS Agent Verification: All RCS Brand Agents must undergo verification per Google and mobile network operator (MNO) standards.
Rich Media & Link Policies: Shared media, action buttons, and URLs must be secure (HTTPS), truthful, and compliant with acceptable usage policies.
Anti-Spam Controls: Unsolicited rich messaging is strictly prohibited. Recipients must be provided clear opt-out mechanisms.

2.4 Email & Bulk Voice Guidelines

Email Regulations: All bulk email campaigns must adhere to CAN-SPAM Act, GDPR, and major ISP authentication standards (SPF, DKIM, DMARC). Unsubscribe links are mandatory in every commercial email.
Voice Call Rules: Voice calls (OBD/IVR) must respect TRAI non-call hours, National Customer Preference Register (NCPR) guidelines, and caller ID verification requirements.

3. Report & Data Availability (60-Day Expiration)

Web Genie Innovation Private Limited provides detailed delivery, analytics, and transaction logs for messaging campaigns. All users acknowledge and agree that:

Reports and delivery logs are available on the Web Genie Innovation Private Limited panel for a maximum window of 60 days.
Users are solely responsible for exporting, downloading, or archiving their campaign logs before the 60-day period elapses.
Upon the 61st day, data is automatically deleted from production and system backups without liability or option for data recovery.

4. Account Suspension & Liability

Web Genie Innovation Private Limited reserves the right to immediately suspend or terminate any account found sending spam, phishing, unauthorized, or illegal messages. The user assumes full legal and financial responsibility for any fines or legal proceedings resulting from violation of TRAI, Meta, Google, or local telecommunications laws.
